Terms of Service

These terms govern your use of Tofiko (“the service”, “we”, “us”). By creating an account or using the service, you agree to them. If you do not agree, do not use the service.

1. What Tofiko is — and is not

Tofiko is an analytics platform. We surface model probabilities, calibrated edges and historical track records for football matches. This is not financial, investment or betting advice, and nothing on the service is a recommendation to place any bet. We are not a bookmaker, we do not accept or place bets, and we do not handle any stake or winnings. Any betting decision is yours alone and at your own risk.

2. Eligibility — 18+

You must be at least 18 years old (or the legal age in your country, if higher) to use the service. You are responsible for ensuring that using analytics of this kind, and any betting you choose to do, is legal where you live.

3. Your account

You must provide accurate information, keep your sign-in credentials secure, and you are responsible for activity under your account. Tell us promptly at info@tofiko.com if you suspect unauthorised use.

4. Plans, prices and billing

• We offer a Free tier and paid Pro and Max subscriptions. Current prices and what each tier includes are shown on our pricing page.
• Prices are in euro and VAT-inclusive for EU customers. Paid plans renew automatically each billing period until cancelled.
• Payments are processed by Stripe. By subscribing you authorise us, via Stripe, to charge your payment method for the recurring fee.
• Where a discounted launch price is advertised, it is a temporary price for a product still in active development. We may change our prices at any time; a change never affects the period you have already paid for, and we give notice before a change takes effect on an existing subscription.

4.1 Season Ticket (founding members)

A Season Ticket is issued automatically to the first 100 people who complete a paid subscription, and carries a permanent membership number. Numbers 1–11 are additionally identified as First XI. Membership numbers are personal, non-transferable, and issued in the order first payments are received.

A Season Ticket carries the following price guarantee:

• Your price is held for the plan you hold, for as long as your subscription for that plan remains active and uninterrupted — not for a fixed number of months. If we raise the price of that plan, you continue to pay the price you were paying.
• You will never pay more than the current price. If we reduce the price of your plan below the price you hold, you are charged the lower amount. The guarantee is a ceiling, not a fixed sum.
• Changing plan. If you move to a different plan, that plan is charged at its current price at the time you move to it — a held price does not transfer between plans. Your held price for the previous plan is retained, and applies again if you return to it while your subscription has remained active.
• If your subscription lapses. If you cancel and later subscribe again, the new subscription is charged at the prices then current, and any previously held price no longer applies. Your membership number and badge are kept regardless.

The Season Ticket offer is limited to the first 100 paid subscribers and may be withdrawn or altered at any time before a Season Ticket has been issued to you. Once issued, the guarantee above applies on the terms stated. Nothing in this section limits your statutory rights, or our right to end a subscription under these terms.

5. Cancellation and refunds

You can cancel at any time from your account; your access then continues until the end of the current billing period and is not renewed. Except where mandatory consumer law requires otherwise, fees are non-refundable, including for partial periods.

EU consumers normally have a 14-day right of withdrawal for digital services. By subscribing and choosing to access paid features immediately, you expressly request that we begin providing the service at once and acknowledge that you therefore lose that 14-day withdrawal right once access has begun.

6. Acceptable use

You agree not to:

• scrape, harvest, resell or redistribute our data or content;
• share, resell or sublicense your account or access;
• reverse-engineer, disrupt or attempt to bypass access controls or rate limits;
• use the service for anything unlawful.

7. Intellectual property

The service, its models, content and branding are owned by Tofiko. We grant you a limited, non-exclusive, non-transferable licence to use the service for your own personal, non-commercial purposes while your account is in good standing.

8. No warranty

The service is provided “as is”. Probabilities and edges are estimates produced by statistical models; they can be wrong. Past performance and historical ROI do not guarantee future results. We do not warrant that the service will be uninterrupted, error-free, or that any outcome will occur.

9. Limitation of liability

To the fullest extent permitted by law, Tofiko is not liable for any betting or gambling losses, or for any indirect or consequential loss arising from your use of the service. Nothing in these terms limits liability that cannot be limited under applicable law, including your mandatory rights as a consumer.

10. Responsible gambling

Betting carries real financial risk. Only stake what you can afford to lose. If gambling is affecting you or someone you know, seek help — for example at BeGambleAware. The service is strictly for users aged 18+.

11. Changes to these terms

We may update these terms; the “last updated” date above reflects the latest version. Material changes will be notified where required, and continued use after changes means you accept them.

12. Governing law

These terms are governed by the laws of Italy, without prejudice to the mandatory consumer-protection rules of the country where you live.
